A judge ruled Wednesday that North Carolina could block an Obama administration rule that would have required restaurants to ask customers how they want their meals prepared.
Circuit Court Judge Claudia Wilken said the state could block the rule until 2016 at the earliest, and the state Department of Health and Human Services did not have the authority to impose it on the state.
Since 2010, the administration has required diners to be able to select their food prepared either by a non-vegetarian or non-vegan option. The rules apply to restaurants that earn more than $10,000 in annual sales. The rule also applies to farmers markets, grocery stores and food trucks.
The Obama administration has said the rule is necessary to improve eating habits and combat the obesity epidemic.
Wilken ruled that the state of North Carolina is “likely to be irreparably harmed if it is forced to implement these new regulations” and that therefore, the federal agency “has no discretion to order the implementation of these regulations.”
Also Wednesday, a federal judge blocked a rule requiring restaurants to post calorie and fat content of menu items. The rule, issued last year, is aimed at spurring public conversations about obesity.
Wilken found the rule to be “arbitrary, capricious and an abuse of discretion.”
U.S. District Judge Joseph Catron said the rule was ill-advised because it would hurt restaurants and force menus to undergo nutritional changes in haste. He said it could lead to confusion among diners.
Catron said the agency did not provide evidence that posting calories and fat content would not cause widespread food industry confusion and harm.
“It cannot be what it purports to be—an optional menu labeling policy—if the health information it seeks is the policy,” he wrote.
